Scheduled flight changes
The departure and arrival times mentioned in the description of the Flight are rarely to changes imposed by the competent authorities. The Air Company has the right to make changes in the following cases:
1) if, at its reasonable judgment, it is necessary for reasons of protection of the health of passengers and/or the safety of the Flight,
2) in case of impairment of the Aircraft,
3) in any case of force majeure,
The Air Company is not under an obligation to perform a Flight different from the one agreed. In case the Air Company accepts the change proposed by the Charterer or the passengers, the Charterer is under an obligation to pay the Fare resulting from the calculation provided for in Terms and Conditions, if, following the change, the Fare exceeds the one agreed upon. In case that following the change the new Fare is lower than the one initially agreed upon, the Air Company is not under any obligation to return any part of the Fare to the Charterer if the Fare has been paid and if it has not, the Charterer is not released from its obligation to pay the whole Fare agreed upon.
Flight Cancellation policy
In case the Charterer rescinds the agreement and cancels the Flight, the Air Company is entitled to withhold or, in the absence of any payment in advance, to demand:
i) Full refunds may be expected only if cancellation takes place at least more than 72 hours before scheduled departure time. However, depending on the case, some administrative charges may apply.
ii) 20% of the charter price withheld if the Charterer gives notice of cancellation less than 72 hours and more than 48 hours before scheduled departure time.
iii) 50% of the charter price withheld if the Charterer gives notice of cancellation less than 48 hours and more than 24 hours before scheduled departure time.
iv) 100% of the charter price withheld if the Charterer gives notice of cancellation less than 24 hours before scheduled departure time.
